Maximum possible penalty for not filing itr ?

This query is : Resolved

16 December 2012 Hello everyone,

one of my client had income of Rs.400000/- and tax deducted Rs.40000/-. but he did not file his ROI.

now he has received notice for not filing the ITR for ay 09-10.

what is the maximum penalty and how i can save my client from penalty ?

17 December 2012 Rs. 5000 is penalty, if you have not received any penalty notice, just file the return and wait if it comes under sight of AO. if AO issues the penalty notice then only remedy is to take the same notice in the appeal which is defiently not suggested looking at the amount involved and complication it will have..

17 December 2012 NON FILING OF RETURN IS AMOUNT TO CONCEALMENT. PENALTY IS MINIMUM 100% MAXIMUM 300%.
