12 August 2014 caclub india has more than 13 lac member.....with many expert..but it seems that no one has courage to speak against ICAI.. i asked that if we did wrong then we are punished for 6 month..i want to know that if ICAI does wrong then can i take any legal action against ICAI if my marks is revised....because there is a long process of valuation then how they can mistake in toalling.... i want to take legal action for my stress my time loss my money..because i have firm believe that my mark will be revised..(plz for reply ,assume that my mark is already revised)

12 August 2014 well it is upto you claim civil damages. The question however is under what law. Consumer Act? I don't think it would apply to this case.

Any organization has a mechanism for redressal mechanism for correcting wrongs such as marks totaling and ICAI has provided for the same. If you wish for a Six - Sigma level of checking, then be assured that ICAI has a right to hike the fees for the same, which would be exponentially higher than the current levels.

16 August 2014 well ok, let me simplify

1. you are speculating as your marks have not yet been revised

2. even where your marks are revised, you can go to court and ask for damages. But on what basis. The ICAI accepts that there are chances of mistake and that is why it has provided a mechanism for resolving such mistakes. I doubt any court will provide any further relief.
