Interest on House Property

This query is : Resolved

03 December 2008 I have taken up a loan in my name to extend the home ( owned in the name of my spouse). So, whether i could take benefit of interest paid on housing loan in my return or not? Because as per one decision given by CIT in case of S.M.A.Sidiqque v/s. CIT (1984)148 ITR 307(Mad.) that one can claim interest on housing loan taken in his name eventhough the house for which loan taken is owned by his wife or children.
