what to do if my hra is not shown in my form 16 and also TDS deducted higher side.the employer is not ready to rectify the tds return now.
what should I do and how I can claim my HRA in ITR for 2012-13
which itr form should i filled up and where i can claim this hra

Even if HRA has not been declared to employer or after declaration also, the employer has not considered HRA exemption, you can claim the same in ITR

Answer to question no.6 of FAQs on Income Tax Returns Filing for A.Y. 2012-13 issued by CBEC.
"Even if the benefit of HRA deduction under section 10(13A) and deduction under Chapter VI-A were not considered by the employer in Form 16, it can be claimed in the income-tax return and, in turn, can claim the refund of excess tax deducted".
