HRA and Home loan benefits at the same time

26 November 2009 an HRA and Home Loan benefits can be claimed at the same time. Both properties being in the same city. Is there any IT law which can be referenced as the employer is denying to give benefits for both.
is there any reference matrial for IT which talks about how HRA and Home Loan benefits can be claimed and what are the contraints / eligiblity to the same

27 November 2009 These are 2 different things HRA comes under computaion of Salary Income Home Loan benefits come under Sec 23 and 80C The reference manual is the Income Tax Act 1961 and the Rules thereunder

27 November 2009 Hi Dhiraj, as you wrote home loan benefit, it means that the assessee owns house property. Hence the rent paid will be Nil. therefore the assessee can not claim exemption under sec. 10(13A). HRA received by him will, thus, get added to his salary income. He can, however, claim deduction u/s 80 C for repayment of housing loan. Regards,
