Hi
I left my previous company on last week of oct 2009. i have written many mails regarding my full and final settlement and form 16. At last 4th of aug 2010 i have received my form 16. They have added 47000 extra in my gross salary in form 16 which is my full and final settlement amount.But they have not paid me the amount. I have written many mails but not getting any reply.Now i have to pay the tax on the extra amount which i have not received.
I need ur suggestion..

You have recd form 16 in which Rs. 47000/- is added extra which you have not received.
if you can prove that amount is not received by you then you can sent them a legal notice for sending fund otherwise you will have only option to go to court.

You may approach them with your Form 16 and ask for the amount which you claim as not received. But befoer steping into your previous empoloyers company, please check:
1. is there any change in your bank account number to which they used to credit your salary.
2. if not carry a copy of the statement for the period three months earlier than your resignation date till the date you plan to go (preffer a stamped bank statement - you may approach any branch of your bank and request for a statement).
3. if the junior level employees dosent respond then approach the reporting manager.
4. but at all times, BE COOL - NEVER LOOSE YOUR COOL. This will have impact when you talk to the employees.
The entire process above is to prove taht your concern is genuine and you are gentleman..which makes the check for the mistake if any on their side.

Welcome to the vast world of Indian MNCs, working under the name of professionalism but working worse than Indian style. You have to move up the ladder for taking up the issue chain wise in trail within the Organisation. I trust this action is not backed by Highest in hierarchy in the Organisation and there are no morality / infidelity issues involved.
I assure you that you have landed in troubles for this Rs 47K, if you are an upcountry employee.
However, keep trying, you would get the money, although belatedly, and donot give up. If ever fed up, speak to me.
