Form 121, replacing Forms 15G and 15H, can be filed only when estimated total income results in nil tax liability. It is meant for eligible individuals or HUFs to avoid TDS, so zero tax liability is a key condition.

I have observed two contradictory opinions on eligibility to file Form 121 under new IT Act 2025. 1]Mr Ashok Kumar has written to a query that form 121 cannot be filed if the incomtax libility is NIL 2]Today Mr.Dhirajlal Rambhia has informed that to file form 121, tax liability should be zero.
Please clear the confusion if my observation is wrong

Form 121 is common replacement of old Forms 15G & 15H.....
For Declarant (Individual/HUF): Check eligibility: o Resident individual or HUF/trust (not a company/firm) whose final tax liability is nil for the year. o Total income (including interest and whatever income subject to TDS) should be such that expected tax liability is NIL. o Valid PAN is mandatory.

I understand your consistent view. But, Mr Ashok Kumar’s clarification on this portal on 07-04-26 is not in line with your information. This is where I sought the confusion to be cleared. Rasheed
