Good day

We are supplying indian man power for foreign shiiping company for job at sea on ship. We charges fees in USD from foreign ship owners/ managers.

are we come under new rule 9 as intermidiatery service provider and comes under service tax liabilities

Rule 9 is applicable if you do not provide services on your own account. Here you are working as main service provider and the same is not covered in Rule 9.
It seems to be covered in Rule 3 and the place of the provision of the service is location of the person receiving the services.
