If we are availed the services like security garud house keeping staff from out side agency the obligation of the ESIC is the whose person availed service.
in same moode if organasation are provide the transport facilities to own employee for by out side agency in this case the ESIC are applicable on organasition

Agency should fulfill the ESIC obligation if agency failed to fulfill the liability then ultimately responsibility on head of principle employer.
