E-way bill issued by us with wrong vehicle no as per recipients information

This query is : Resolved

24 January 2024 We sell goods to our customers and make e-way bill as customer direction without checking the vehicle physically. Now if the customer gives wrong vehicle no is it our fault?

06 July 2024 If you make an e-way bill based on the customer's direction without physically verifying the vehicle, and the customer provides incorrect vehicle details, there are implications to consider:

1. **Responsibility for Accuracy:** As the supplier generating the e-way bill, you are responsible for ensuring the accuracy of the details provided in the e-way bill. This includes verifying the vehicle number if you have the means to do so.

2. **Consequences of Incorrect Details:** If the customer provides incorrect vehicle details and it leads to issues during transportation or compliance checks:
- **Penalties:** You could be liable for penalties or fines if the e-way bill details do not match the actual transportation.
- **Compliance Issues:** Non-compliance with e-way bill rules can lead to legal and procedural complications, including delays in transit or delivery.

3. **Mitigating Actions:**
- **Verification:** If possible, verify the vehicle number provided by the customer. This can be done through direct communication or by requesting proof such as a photograph of the vehicle number plate.
- **Documentation:** Maintain records of communication with the customer regarding the e-way bill details. This can serve as evidence of your due diligence in case of disputes.
- **Communication:** Clearly communicate with your customers about the importance of providing accurate vehicle details for e-way bills to avoid compliance issues.

4. **Legal Perspective:** According to GST laws, the responsibility for the correctness of e-way bill details ultimately lies with the person causing the movement of goods, which in this case is the supplier. Therefore, it is advisable to take reasonable steps to verify vehicle details to ensure compliance and avoid penalties.

In summary, while you rely on customer-provided vehicle details for e-way bill generation, it's essential to exercise due diligence to verify or validate these details wherever possible to mitigate risks associated with incorrect information.
