My client is a CMD of a public limited co. & CMD of a Private Ltd. Co. He deposited his capital gain depoist on 29.09.2009 to avail exemption u/s.54F. In this case whether his due date is 31.07.2009 or 30.09.2009. for filing his return.

The due date of return does not depend on the investment.
The due date depends only on 1 thing, whether the assessee is liable to tax audit or not.
If the assessee is not liable to tax audit, due date is 31st July.
If he is liable for tax audit, due date is 30th September.

My client has deposited capital gain amount on 29.09.2009. wherein the due date for filing his return was 31.07.2009. Under this circumstance can he take the weightage of Gauhati High Court in the case of CIT v. Rajesh Kumar Jalan, 286 ITR 274.
