Double Tax Avoidance Agreement..Urgent Sir!!!

24 July 2010 Dear Experts,
If a person has been taxed in India as per Double Tax Avoidance Agreement means, while calculating the tax liability can we deduct the basic exemption limit.
For Example his income is 9 lakhs for the assessment year 2010-11, while calculating the tax liability should i have to deduct the basic exemption 1,60,000.

26 July 2010 Withholding tax under the DTAA is to be done on the gross income. Basic exemption limit of Rs. 1.6 lakh is not available under DTAA.

11 August 2010 Kindly provide the exact case details for having a detailed answer.
