This query is : Resolved

10 March 2015 Is there a service tax liability if a director receives remuneration from two private companies? If yes, then who is liable, the company or the director?

10 March 2015 Company is liable to pay service tax under RCM on payments to directors - non executive (non employee)

10 March 2015 Nilesh, thanks for your response. Is it not possible that the director is working part-time in both the companies?

10 March 2015 If you are treating them as an employee of the company and issuing form Form 16 -income tax and then only you are not liable to pay service tax

Part time and full time is irrelevant factor to determine

Trust the above clarifies.

10 March 2015 Thanks Nilesh. It seems that the issue gets resolved.
