25 July 2014 As per the new companies act 2014 , directors are disqualified for five years if annual returns are not filed for a continuous period of three years .

Does the disqualification get removed immediately on filing the returns

25 July 2014 Now the same is regulated by Section 164(2). As per my opinion Disqualification gets removed as soon as company files old pending returns. After filing all pending documents name of the Company shall be removed from the list of defaulting companies and likewise name of the Director shall be removed from the list of defaulting Directors.

After making the default good, he will be able to give form DIR.2 for appointment in new Company. You are advised to wait for the opinion of other experts w.r.t. your query.
