Someone may please reply to the following queries :

Applicant - Indian National, who is a student (doing professional studies abroad - hence NRI)

has come to India for a short visit say 15 days.

Now, the applicant proposes to have DIN.


Query

Whether in Form No.DIN-1 - Field No.4A - Whether resident in India

Ans :................. (Yes / No)


Whether VISA (including Passport) is mandatorily to be obtained.

Ans :......................


Whether Affidavit shall also apply to the said NRI.

Ans : ..................... (Yes. Please confirm)


As the said applicant is presently in India, can I go ahead in executing Affidavit on Rs.10/- stamp paper and
obtain Local Notary Public attestation. Is this a proper compliance?

As the said applicant is presently in India, can a Practising Professional digitally sign the DIN Form?
Is this in order?

Not related to the above queries

If Affidavit applies to NRI and Foreign National (who stay abroad), how to execute and obtain attestation.

If such Person have Indian resident address and Indian PAN then you can apply on the basis of both documents. Basically he is resident in India but went for studies.

I will suggest you to apply DIN as resident in India on the basis of Indian documents.

Affidavit will be required only when if you have any abbreviation of name of the applicant or his or father name, otherwise not required.

Please have a look at the latest DIN-1 help file.

FYI

Affidavit by the applicant to be executed on non judicial stamp paper (Rs.10/-) and duly notarised . It is a mandatory attachment.

Other supporting documents like affidavit in case of single name etc. or any other information can be provided as an optional attachment.

AS PER FEMA - An Indian National, who went abroad for studies will be treated as NRI only, though he visits India for short stay. Now, he is in India.

I will again suggest you that if you have Indian documentary proof and PAN then you file DIN as Indian resident.
