CST/Excise duty paid is allwed as Input Credit or not??

24 October 2010 our client is proprietor registered under mvat

on purchases he has paid rs.500 as excise duty and 100 as cst.

is 600 allowed as credit against sales tax payable.

24 October 2010 Rs.100 paid as cst will not be allowed set-off (input credit).

Rs. 500/- paid as excise will be allowed credit for cenvat if the finished goods in which this items will be used is not exempt from excise duty.

25 October 2010 CST credit not allowed and excise duty not for sales tax. its seperet issue. you cant not use Excise to setoff vat libility.

Both are not allowed.

25 October 2010 no you cant avel both set offs as CST credit is not allowed for vat
excise paid by client is added in assessable value ( material value)and this excise amount paid is also not available for setoff against sales tax
