Creation of charge of a defaulting company

Please tell me whether a charge can be created by a bank on the property of company which has made default in filing Annual Return and Balance sheet of 2009-10 and onwards. Moreover the charge was created in the year 2011 and will have to be registeres after applying for condonation of delay with Central Govt.

10 August 2014 If status of the company is "dormant" e-filing of charge creation is impossible till it is changed to "active".
