COMPOUNDING TAX FOR CIVIL WORK IN KERALA

19 February 2011 PLEASE HELP ME IN URGENT ..REQUEST..........................WE THE CIVIL CONTRACTOR OBTAINED COMPOUNDING PERMISSION FOR EACH WORK IN 4D FROM THE DEPARTMENT. IN THAT 4D FORM BOTTOM SIDE CONDITION (2) PRINTED AS "PERMISSION -HOLDER SHALL NEITHER COLLECT TAX NOR CLAIM INPUT TAX CREDIT ON TAX PAID INPUTS.
SO INPUT TAX CLAIM IS NOT ALLOWED.-AGREED.

THEN MY DOUBT QUESTION IS WHETHER CAN WE COLLECT COMPUNDING TAX (3.03%) FROM THE AWARDER ?? AND HOW WE WILL SHOW IN 8CA INVOICE BILL?? (NOTHING SEEN IN THE ACT )iF SO PLEASE GIVE ME ADVICE & DETAILS

19 February 2011 From 1-4-2008, KVAT @ 3.03% can be collected by virtue of an amendment in section 30(2)of the KVAT Act,2003 brought in by the Kerala Finance Bill,2008. However corresponding change is not seen made in form 4D. Form 8CA is introduced in the statute by an SRO dated 31/12/2007 in which also consequential change for the above referred amendment has also not being made.

please help to sort out the folowings.

1)still the concerned tax officials are saying that compounding tax payer on works contract should not collect that tax from the awarder. is it tue or not. Also seen in the new form 1EE also (against old 4D)..

2) Is there any rule that, can we file revised 13 & 13 A.
