I purchase cable from supplier on which VAT levy and same supplier made installation work on which he was levy Service tax@12.36%.(Puchaser(I'm) is Builder. In bill Both were sepertly show(single Bill)

So my Que is whether I can take credit of service Tax for paying Service Tax.

Further, Can we Take cenvat credit of Service Tax on lift installation made by supplier for building.

11 June 2015 Query 1 - Whether credit can be taken or not would depend on the usage of cable. If the cable is not used for laying of foundation or making of structures for support of capital goods then credit would be available.

Query 2 - Yes credit can be taken. In addition to Service tax credit, the possibility of availing Excise duty credit on lifts (which is generally included in the cost) should also be explored.

Regarding

Query 1:

I am builder.we develop flat scheme and cable was use for flat which is at present my WIP.

So, can I take credit of service tax for paying a service tax.

Query 2:

Same as above , lift also use for flat scheme.

So Can I take cenvat credit of excise duty for paying a service tax.
