23 March 2011 CENVAT balance for the month of April 2010 is Rs 60,000
Service Tax Liability for the month of April is Rs1,00,000
Service Tax pain on 5th of MAY 2010 as:
Through PLA:Rs 50,000
Through CENVAT: Rs 50,000

Will it be considered as late payment out of CENVAT??

23 March 2011 No, its paid on time as 5th of next month.

Tax Liability for the month of April is Rs1,00,000 is not service tax its excise duty liability. please see again.

23 March 2011 Thanks. Can you please give the rule or section reference as AO has charged interest for one month @13% on Rs 50,000.

and it is service tax liability only.

23 March 2011 Service tax can not pay by excise cenvat. if its service tax cenvat balance then you can pay.but you will pay fron PLA up to 5th of next month its excise and service tax rule.

if you are paying by cenvat debit it on same month.
