Amendments in section 50c

Dear All,

Can anyone tell me the proposed changes in section 50c in case of stamp duty valuation?

whether purchaser ( transferee) is liable to pay tax on difference amount??

Death of director

Our Client is a pvt. ltd. company having 3 directors holding 4000,4000 & 2000 shares respectively.Total no. ofpaid up shares are 10000.
Director holding 2000 shares expired in Dec 2012.We have filed form 32 of deceased director.
My query is whether we have to file any form for shares held by deceasesd director.What to do with 2000 shares held by him.

Kindly remove my confusion as to whether a belated service tax return can be revised or not?? I have got following two different opinions-

I)A service tax return can be filed under Sec.70(1) of the Finance Act, 1994 (“Act”) Furnishing of returns. — [(1)] Every person liable to pay the service tax shall himself assess the tax due on the services provided by him and shall furnish to the Superintendent of Central Excise, a return in such form and in such manner and at such frequency [ “SECTION [70.and with such late fee not exceeding [twenty thousand rupees,] for delayed furnishing of return, as may be prescribed.]”
Its apparent from the above that the Sec.70(1) of the Act governs both the return filed within the due date and the belated one.
Therefore,a Service Tax return which is filed after the due date, as prescribed under Rule 7C of the Service Tax Rules, 1994 (“Rules”) is also a return filed under Rule 7 of the Rules read with Sec.70(1) of the Act. Hence, a belated Service Tax Return may be revised as per Rule 7B of the Service Tax Rules, 1994.

II)As per provision (Rule 7B) has been incorporated in the rules to provide provisions of filing a revised return. Accordingly, in case there is a mistake or omission in the original return, a revised return can be filed with in a period of 90 days from the date of filing of original return,
As per the provisions of rule 7B a return can be revised only if the original return has been filed under rule 7. Means thereby, a revised return can not be revised again. Similarly, a belated return can not be revised under rule 7B.

Capital gain

If land inherited by wife is gifted to husband and the land is sold by the husband , whether these capital gain will attract clubbing provision under Income tax . I need the urgent advise from Expert on this matter

Which type of accounts can be ask at any time by DVAT inspector at registered premise under DVAT? Also please tell me that how they can cross verify with default in payment of VAT?

Pan card

Dear Sir
The person having only ration card and Aadhar card

There is no date of birth on the ration card and also there is no any other proof of date of birth

so how can a person can apply for pan card

please suggest me as early as possible

on that if tds is applicable on which amount i have to calculate tax excluding service tax or on total invoice amount. at present we are calculating tds on the base amount( Rs. 10,000).
which is correct and better. please suggest with the support references of IT dept. Service tax dept.,if any.

Provision for bad debts

Dear sir
can any one help me. My problem is our company has decided to make 5% provision for bad debts on debtors. So what will be the entry. I think
Bad debt (ind.exp in Tally) Dr 25000
To prov. For bad debts (s.debtors in Tally) Cr 25000
Then later if we have identify the bad debt amount only 15000. Then the entry
Prov.for bad debt Dr 15000
To Bad debts Cr 15000.
Is it correct? If not please rectify my two entry's.

Final registration

Dear Sir,

I have passed the CA-IPCC-I exam in NOV-11 and have started my articleship in June 2012 and passed the second group in Nov-12.

My question is when can I register myself for CA-Final(last date). And also tell me about the GMCS 1.
Can I get registration in Final and also for GMCS at the same time.

I hope I will get a satisfactory reply.
