Mr. A follows cash basis of accouting.
He issued 2 cheques on 31.03.2008. One is cleared on 02.04.2008 and another on 26.04.2008...(after 26 days from year end).
Whether these cheques issued can be treated as expenses?
Is it necessary that payment should be reflected in bank statements to claim it as expense in case of cash basis?

We have paid service tax on input services & claim cenvat credit against renting of immovable property.
But Service tax dept. has taken objection and told us to pay service tax in cash.
So we have paid service tax of the amount of cenvat credit through cheque.
Now my question is that
The cenvat credit which we have earlier claim in the month of July, Aug, Sept, Oct, Nov, Dec, Jan, Feb, Mar can adjust against the payment of excise duty on manufacturing of excisable goods , on 1st april 2008.
Service tax provider shouldnot collect and pay service tax if his gross billing is less than 8 Lacs for the year.Now Till February our billing is less than 8 Lacs and in march Bill from a special client was rs. 2 Lacs. Now we have to pay tax on different or whole billing?
