1) Whether the loan taken by a Company from NBFC treated as deposits?

can anyone please let me know time period in which NCLT permission can be taken for using different financial year in case the company is subsidiary of a company incorporated outside India as my client is having its year form 1st March to 28th feb and we have not taken any permission as yet.

Please reply its really urgent.

as per new companies act 2013 a company cannot give loan or investment to director .

my client is director in 16-17 private companies . the companies have internal group transactions. ie loan given and taken . the compaines have purchased share in sister concern though the holding is less than 10%.
what should be done for these loans and investment according to the new companies act.

If a company wants to reduce the subscribed capital mentioned in memorandum at the time of incorporation, so is their any provision for reducing the same in companies Act 2013

my query is regarding appointment of Independent Director, exmpl:

X Ltd is a Listed Entity, Mr. A and B are the directors of X Ltd.and they are called Independent Directors, but they are also Director of 5 (Five) Associates Companies of X Ltd. a listed entity and they also take salary on Per month basis from one of the 5 associates Companies.

the above is the example so kindly confirm me from yours valuable opinion Mr. A and B are really Independent Director of a X Ltd. Listed entity.

i would like to know that in my pvt ltd company , both of my directors give an unsecured loan to the company, which is excess the limit of paid up capital and free reserves, so i want to whether sec 160 ia applicable in our company and we have to pass a special resolutions or not?

a private company has 20 partners,including a private company which is having 30 shareholders. is it an illegal association as per sec 11 of companies act? suggest if not than what are the reasons for thia casa.
