Value for service tax

DEAR EXPERTS

IF THE LAND OWNERS OF THE PROPERTY COME TOGETHER AND FORM A PARTNERSHIP FIRM TO CONSTRUCT A RESIDENTIAL COMPLEX ON THEIR UNDIVIDED SHARE OF LAND AND CONTRIBUTES THEIR OWN CAPITAL FOR CONSTRUCTION PURPOSE AS WELL AS RECEIVES THE ADVANCES IN THE NAME OF THE FIRM FROM THE PROSPECTIVE BUYERS, ON WHAT VALUE THEY HAVE TO PAY SERVICE TAX ?

ARE THEY LIABLE TO PAY SERVICE TAX ON EVEN CAPITAL CONTRIBUTED BY THEM FOR CONSTRUCTION OR ONLY ON ADVANCES RECEIVED
FROM PROSPECTIVE BUYERS OF THE RESIDENTIAL HOUSES / MULGIES.

MY CONTENTION THAT THE OWNERS AND BUILDERS ARE SAME HOLDS GOOD. PLEASE CLARIFY THANKS IN ANTICIPATION

Service tax liability

Good afternoon experts,

1. If a partnership firm pay freight inward Rs.2000/- in a single entry & similarly paid Rs. 82000/- in the whole f.y. 2012-13. whether it is necessary to take registration of Service Tax. (Total sales = 1.2 Crore)

2. Same condition for individual having tax audit & with out tax audit.

Please advise.

Service tax ssp exemp query

During the course of departmental audit it was observed that the service provider didnot claim SSI exemption for the first three quarters , but he claimed the same in the last quarter.....but deptt has raised objections and demanding differential tax ...... Please suggest any remedy available to challenge the audit objection?

Rent-a-cab

WHAT IF THE SERVICE PROVIDER HAS RAISED BILL FOR PROVIDING RENT A CAB SERVICE AND CHARGED 40% SERVICE TAX....BUT THE SERVICE RECIEVER HAS LIABILITY OF 60% AND SERVICE PROVIDER HAS 40% LIABILITY????
WHAT SHOULD WE DO?

Hi,

Can you please let me know whether budget 2013 proposals(such as reduction in excemption for charitable trusts from Rs 25lacs to rs. 10lacs) relating to indirect taxes is being accepted(for example, direct taxes proposals in Budget 2013 was passed in lok sabha and Finance Act 2013 for direct taxes came into effect 10.5.2013). If yes please given reference/link.

Dear Colleagues,
During import clearance, we pay lots of services tax to various agencies e.g..shipping companies, logistics companies for cargo handling charges, documentation charges etc
But we pay to our CHA & he in turns pays to them. But in the invoice our name is written as consignee.
Whether we can claim cenvate on all such service tax?

Input tax credit

Our client is setting up new factory for manufacturing excisable goods... during set period it has received various services on which service tax has been charged... whether such credit can be utilized against excise payment when goods are manufactured???

Dear fellow
Good evening..
My q fact is...
A company exempted from excise duty for main product,but liable & paying right now excise duty on ancillary /byproduct.
My question is can above said company take input CENVAT credit of service tax paid under reversecharge mechnism which fall under input detonation.

Payment of service tax

I have a query, that my gross receipts does not exceeds Rs. 10 Lakhs but I am providing taxable services whether I have to pay the service tax collected on receipts collected by me and I have been voluntarily registered under service tax.
