Registration of premises

A person has been providing Construction services as proprietor and he got registered with Service Tax with his existing firm name (Eg. X constructions).
Now he starts a new business of man power consultancy with a name called (X Technologies) from the same premises.

should he get registered for the new concern seperately? because the existing is in the name of X constructions whereas this new business name X technologies.

Please share your valuable inputs

Service tax return

Dear All,

Our company had filed return of service tax for second half of the 2011-12 well within due date but we were unable to revise our service tax return due changes in accounts department within due date.

Now, our closing balance reflecting in return is lesser than actual CENVAT balance by 40 lacs. Now, I have to file return for 1st quarter before 25th Nov.2012. Request you to suggest how to take benefit of the same.

Services rendered prior to regn

my client is having turnover below Rs. 10 lakh. Eventhough he has registered himself under Service Tax Act .
He had submitted Works Contract bills amounting to Rs.250000 in the month of July which are sanctioned during November 12
Please guide whether to Pay Service Tax on the amount of Works Contract bills submitted prior to Regn even if he had not recovered Service TAx from Company
and whether basic exemption is available under service Tax Act

Reverse charge on manpower supplier

We are Limited company which is hiring services of manpower supplier.as per Reverse charge mechanism Service receiver is liable to pay 75% of service tax.but if turnover of Labour supplier in previous financial year is less than 10 Lakh and in 6 month of current year bill value is 6 lakh than whether company is liable to pay any service tax?

Sir,
we are manufaturer of plastic based fleible packaging film materials.we book the order for engraving or re-engraving of printing cyliders as per design and artwork approved by customer , manufacturer of cylinders make invoice in name of customer , but as per terms condition we get commission on the order of such customer.

some time we may to pay commission to the person who place their customer order,

is commission income or commission expense attract service tax liability, can we collect this service tax from cylinder manufacture to whom we book order of our customer.

can cylider manufacturer avail credit of service tax paid on commission income which is payable to their order booking person.

Hi,

Question 1
Do service tax have to be paid for transportation expenses that a pvt ltd is incurring in procuring material and sending finished product to customers.
If yes how much percent of the total assessable value will be considered for service tax as per reverse charge methord applicable from 01.07.2012.

Question 2.
What to do
a)if the transport provider included service tax
b)if the transporter didn't include service tax.

Service tax on rentof flat

DEAR SIR

WE ARE MGF PVT LTD. CO.
WE HAVE GIVEN A FLAT ON RENT TO PANASONIC CO. PVT LTD.
PANASONIC CO. IS USING THIS FLAT FOR RENTING OF THEIR MANGER FOR RESIDENTIAL PURSPOSE.
SO I WANT TO KNOW IS THEIR SERVICE TAX IS APPLICABLE ON THIS FLAT.
BECAUSE AS PER MY KNOWLDGE SERVICE TAX IS NOT APPLICABLE ON RESIDENTIAL FLAT

Hi, Does anyone know bank branches that collect physical payment of service tax, because one of my friends is not able to pay through e-payment by his bank. He is not willing to open an account to just pay ST. He has been running around blindly so I thought some could help from this forum. Appreciate any help.

Reverse charge


Sir,

we are running main power placement (Recruitment) agency, now we are charging to Vodafone co on of the our clints. as Service Tax @12.36% for placment of candidates.

pls let me know can we covered under reverse charge machanisum, if we covered under it what we have to do.

Rate of tax to be taken

if bill was raised before 1st april 2012 and the payment is received in current date than at what rate service tax is to be paid,i think it should be 10% but i found 12% is taken into account .suggest please
