service tax


A Service provider in the nature of outsourcing employees (in its rolls) to its client(employees working at client place), raises invoice for salary of its employees working in its client place (salaries paid by service provider & reimbursed by client). Can they charge service tax on the salaries(includes pf& esi) or just on the service charge they levy? Both are charged in the same invoice.

Service Tax on Rent

i am working for a private limited company they are paying rent of Rs. 275,000.00 per month whether they have to pay service tax on the above mention rent. please guide me.

Renting of immovable properties

Hi all,

Kindly clarify on the below issue.

I own service apartments. I raise invoices on customers inclusive of service tax. I charge service tax on the whole amount of rent without deducting municipal taxes paid and collect the service tax.

While remitting the same to the government, I deduct the corporation tax from the rent and compute service tax and remit the same.

Can I Do so? What is the remedy for the same. should i refund back the excess amount collected to the customers

Applicability of 10%

My client is a Commission Agent for the manufacturing company, he only receives the commission after getting claring the payments from the customers. The manufacturing company raise the invoices to his customers and gets the payments after the credit period (say 45 days). The commission agent raise his bill only after clearing the payments by the cusomter to his manufacturing company. My doubt is, for the invoices raised during the month of Jan-09, the commission agent raise the bill only during Mar-09, what is the service tax rate applicable, is it 12% or 10%

Our House keeping service provider bills for the following
1. Wages paid to manpower supplied
2. service charges of the service provider
3. Materials supplied like toiletries and other house keeping items.

He charges service tax @ 12.36 on all of the above . Is he correct in doing that.

New rate

Service tax has been amended wef 24.02.2009. Now one of our service provider submitted service bill ( security services)with including srvice tax 12.36% and the bill date is 01.03.2009. Now my question is whether nwe rate (10.33%) or 12.36% will be applicable to this bill. Pls clarify

erection service

my client is providing a erection,commissioning and installation service (he provide in his bill only commission not including goods value)so can he claim 67% exemption limit on service tax.

CENVAT Credit in Service Tax

Dear Sir,
I have a query that how many Percentage i can utiliese cenvat for the same catagory? Is it maximum 20% of total service tax payable of the same catagory?
