A private firm engaged in undertaking annual service and maintenance contracts ( civil repairs,white washing, painting etc) and duly registered for payment of service tax and paying service tax regularly for the last five years have been told recently by the Service Tax authorities to pay service tax arrears for the last five years taking into account the cost of Paint and other materials ie., 100 per cent cost. So far they were paying service tax only on 40 per cent of the bill presuming that tax is not payable on the cost of materials.
Is the claim of Department legitimate?
we get commission as per tender from hpcl as input output stock management.
i.e. we maintain stocks of hpcl and get commission.
should I pay service tax, if yes, how should I raise invoice and how can I take cenvat credit ?
A company send us goods to their warehouse and we supply goods as per their instructions. our role is to keep safe their goods and input and output management of stock.

A company is a dealer of sanitary ware products at the time of supplying goods to the buyer company itself is bearing transportation cost and all the goods are supplied through roads only, therefore in this regard I want to know whether Service Tax is applicable on the transportation charges while supplying goods to the buyer.
If Service Tax is applicable then under which category of such service will be leviable.

We are contractor.
When we issue invoice for our work done we issue 2 separate invoices for Labour work done and material supplied by us.
My query is whether we are covered under work contract and reverse charge is applicable on us. Or Simply we will cover under Construction service in respect of commercial or industrial building and civil structure.

In our company we have to receive export receivables and make import payments . Can we net off payments and make balance payment to same party in foreign currency? If we net off the overseas payables with receivables, whether service tax liability will arise in such case for the transaction we are treating as exports according to export rules?

sir i registered with ST Dept. in may, 2012. I did'n file my return before due date. Now before filing my return i deposited penalty for late filing of Rs. 2600.
I have not raised any invoice during the period Apr-June.
I have given challan details in
coloumn 4.( challan details for advance payment)
& 4A. part II. and also mentioned this amount in 4A. (I) d(viii) as penalty.
Am i correct or not?
please help me if there is any mistake, where to fill this amount.
