Interest to relative o a director

Can a company take loan from relative of a director or HUF of director? If yes, can a company give interest on loan to that relative or HUF? Please suggest can it be legally or on accounting basis a valid tranasction and also according to company law?

Partnership or Company?

A person wants to start a business (relating to induction of iron i.e a foundry etc) where big investment is required and also the turnover will be in crores. In this case which is more beneficial - partnership or comapny???
According to me i think Company is a better option. Please guide me whether i m right or not????

Incorporation of a Company

In case a person wants to start a business of foundry (relating to induction of iron, magnese etc) for it he is incorporating a company. Before this he wants to purchase a land. If the land is purchased in the name of the prompter, can that land be used in the business i.e. in the company after its incorporation? or Should the promoter first incorporate the company and then purchase the land in the name of the Company?
What should be done and what will the accounting treatment in the former case? And also suggest as there is any requirement of transfer deed to be made in the former case from the promoter to the company or it can be used in the name of the promoter by the company?
plz suggest at earliest as possible.

Trust

I am planning to purchase a property for building apartments. but the problem is that the land is held under a trust. my query is that can the trustee ( who wishes to) transfer such land to me.. if no then is there any other alternative because on selling the apartment registration would have to be done in the name of the owner. the trust deed provides that the land can be used for the purpose of building a school or a hospital..

PF LIABILTITY OF CONTRACTEE

THE COMPANY(PF IS APPLICABLE) HAS ENGAGED A CONTRACTOR FOR WORK AND CONSTRUCTION PROJECT . NOW MY QUESTION IS THAT IF THE CONTRACTOR DOESNT DO COMPLIANCE OF PF ACT, WHETHER THE LIABILITY OF PF PASS ON TO THE CONTRACTEE COMPANY.

PLEASE PROVIDE THE RELEVANT SECTION OR CASE LAW (IF ANY)

Can an Indian Co. held shares in Foreign Co. & upto how much amount an Indian Co. held shares in F. Co. without RBI approval.

Registration of an Association

Dear All

I am desirous of forming a AOP. The desired name will be Gujarat Steel Traders Association. The association will be for the benefit of all the steel traders and manufacturers of Gujarat.

My query is where should i register this AOP. I mean will it be registered as a society, trust or is there any separate registration for NTC like these.

In case of Preferential Allotment of Equity shares, the Pre-Preferential allotment shareholding of the allottees shall be locked in from the relevant date upto a period of six months from the date of Preferential Allotment.

So, my query is that whether it will be locked in from the relevant date upto a period of 6 months or whether it will be locked in from the date of Preferential Allotment?

The query was resolved but i am yet not clear. Can anyone give an example and explain?

is companies act 1956 applicable to foriegn companies?? and is the same applicable to statuitary companies???
if ans is no then which law govern the foriegn and stauitary companies???
are statutory companies registered under companies act 1956???
