Validity of appliction before issuing of cert of incorpation

Dear All,

My query is whether a company can apply for any project/tender before issuance of Certificate of Incorporation but after name approval. At the time of applying, Certificate of Incorporation was not given.

As per Section- 147 of the Companies Act, 1956. If a Company fail to paint and affix it name and address of its registered office, on the outside of every office or place in which its business carried on, the Company and the every officer of the Company shall punishable with fine.
So, can any one tell me that against that defaulted Company any person can lodge a complain or only some specified person ?
