Please clarify,
i) Amount of Cenvat credit eligible in case the supplier EOU removes goods under sl. No. (1) of Notification NO.23/2003-CE dated 31.3.2003 or without availing exemption under Notification No. 23/2003-CE.

(ii) Whether the Cenvat credit is eligible on EC & SHE components prior to 7.9.2009 (as I come across a case law “EMCURE PHARMACEUTICALS LTD Vs COMMISSIONER, PUNE - 2008 (225) E.L.T. 513 (Tri. - Mumbai)”, which allows credit on Education Cess) ? If yes, whether Cesses paid on CVD or Cesses paid on aggregate duties are eligible for Cenvat credit.

We are mfg(EOU) of plastic components for UK country.And that components are delivered to his dealer in India.

is it is acceptable as per customs if it is please let me know the procedure.

hi

this is with regard to making import bill in local currency. Whether an importer can make an invoice in indian currency rather than foreign currency. if he cannot make so, kindly let me know in which rule, it is prohibited

Cenvat credit avaliablity

Whether CVD u/s 3(5) [i.e. amount equal to the duties of excise on like products when manufactured in india] is avaliable as cenvat credit for payment of service tax on output service provided by the service provider?

Also such SAD consist of (EX duty+EC+SHEC). So whether all three elements are avaliable without any restrictions except ofcourse for EC and SHEC is for respectives.

Is Violation of FEMA Act1999

Question: XYZ Pvt Ltd registered in India who is importing raw materials from ABC Enterprises who is registered outside INDIA. ABC Enterprises supply materials to XYZ PVT LTD at site. The expenses of customs duty, transportation charges, service tax and any other charges is born by ABC Enterprises. XYZ PVT LTD paid material cost, customs duty, transportation charges, service tax and anyother charges to ABC Enterprises after 30 days of delivery of materials. So, is there any custom / FEMA violations in this transaction.

Import of Walkie Talkie

Hello ,

I am from Assam . I want to import two UHF 5 WATT Walkie talkies from CHINA . I do not have a import license as the items are for my personal use within my house and for trekking and outdoor activities outside the city . The total value of the walkie talkies is not more than 70 $ . Do I need a license to import walkie talkies ? Also , the local store here told that no license is required to operate walkie talkie sets as long as they are used with care , responsibility and in private . Also , what is the customs duty levied on two way radios ?
Please clear my doubts

Exported material to be returned back

We have exported accessories for garment manufacturing to Nepal. Due to delay in supply Ready-made garment buyer from India has cancelled the order.Now the manufacturing unit in Nepal wish to return the material. We are also ready to take back the same to have the good relation with the manufacturing unit.
Plz suggest what is the process need to be followed for getting the accessories back to India??

Profational Tax

Dear Sir

I have some confusion in Probational so please sir done it.
we have open branch in Rajkot from 2003 and that time company have a 2 empl. after than some year to presently 10 empl.doing work in our branch, in 2003 to continues we have paid probational tax in our origin head branch Baroda but now we will decide to pay PT in our city so what is processor it?
1. Have we start new accounts or continues
transfer from there city?
2. have paid to continues tax / or paid to
penalty form 2003
3. if There are not accepts for our
accounts so what will be done
processor?

hello all, i will be pleased if u answer my following questions relating to BILL OF LADING........ Thanq in advance
1. who notifies the party?
2. who are such notified parties?
3. is notified party always to be importer or bank or may be anyone else??
4. what is meant by TARE?
5. what is destuffing charges?
6. who can exclude the applicability of any foreign rules for any particular carriage??(written in one of bill that a particular rule in not applicable to this carriage..)
