Passing of cenvat credit

Whether ultimate buyer will get CENVAT credit in following case and if yes, how?

Example
There are three party involved in transactions.
A (based outside india and trader)
B (Based in india manufacturer)
C (ultimate buyer based in india)

Suppose A buys excisable goods from B and sales it to the C.

B invoiced to A and A invoiced to C.

Goods directly moved from B to C.

Excise

Can i knw on which items Excise credit is available ?
Also if i m filling TDS return in nov 2010 of 2009-10, we had paid TDS amount on nearly before 15th Oct 2010.Is there any penalty other than interest upto 15th Oct 2010.

Re importation of Goods

hello, my query is that, when goods are exported from India, then no duty is leviable, but the same goods have been rejected and come to india. But the Indian manufacturer sells the same goods in India, by correcting the defective parts.

I am confused, because the law says at the time of reimportation custom duty will be levied and the same goods have been sold in India also.
Whether there would have to pay a normal duty as in case of goods sold in domestic market or not? And if not then how?

If yes, then there would levy custom duties at the time of importation as well as at the time of Domestic sales. So around 40% would be going as duties and taxes.

Excise credit pass on to customer

We are reg istered Trader under excise. We are importing the goods and taking input credit CVD, Cess and Edu. Cess on CVD and Sperical add duty on CVD.

Whenever we raising invoices to party we just passing iput credit amt to customer.

Is it correct paractise? if yes can we transfer the CVD input credit to customer?

Please advise

Export under rebate claim

Kindly guide detailed procedure of Rebate claim. What kind of rebate do excise gives us whether it is export incentive or its the duty paid in cash at time of removal of export consignment refunded to us. Whether cenvat credit is refunded in this way what exactly is rebate claim kindly help

Cenvat Credit

A Govt. Company manufactures eight to nine products out of which two products are excisable. This being a process industry.

Can Cenvat Credit can be availed of

a. Excise duty paid on the procurement of raw materials. and

b. Service tax paid on the expenses of Security forces.

However, no clear cut bifurcation is possible nor made to indentify the raw materials procured for each product. Similary the security charges is also for the entire plant and product wise is not identifiable.

If the Cenvat Credit can be availed then,
a) is it on the total amount of service tax paid by the Co. or only limited to two products which are excisable.
or
b) Or can Modvat credit can be avialed on the entire service taxes paid for all the products incling excisable and non - excisable.


For costing purpose based on pre-determined per centage allocation of various expenses is made, can this be the base for claiming Cenvat Credit

Excise Registration

Dear All

We have Registered Office in Delhi and branch office in Mumbai. We are already registered in Mumbai under Excise but not registered in Delhi because we don't have any Godown or Warehouse in Delhi. Now we have acquired a Warehouse in Noida for that we will get registerd under Sales Tax & Excise.
Can we issue Invoices from Delhi Office for goods transferred from Noida or we need to open a physical ofice in Noida?
