Is Cenvat credit available for the assets purchased and used in the scientific research for producing excisable products.

Cenvat credit in case of r&d meterial

Is CENVAT credit available for material used in Research & Development? Research is being carried out in the factory premises. Provide case laws, links.

Ours is a greenfield project. We started receiving capital goods. However, there was a time lag before excise registration was obtained. We have not started manufacturing operations since the Company is still in project stage. Can we now claim CENVAT credit on cap. goods for the short period when we did not have excise registration?

Two separate excise invoice in one factory

Dear Experts

I am facing a specific problem.

One of my client is having plant of fabrication. He wants to have two separate excise books as these are selling by different internal departments.

I have searched Excise rules but not getting any reference whether he can have different books or not

kindly help

your answer must have support of rules or judgements

WE HAVE IMPORTED CERTAIN MACHINERY AT CONCESSIONAL RATE FROM US. OUR PLANT IS UNDER INSTALLATION AND DUE TO SHORTAGE OF STORAGE SPACE, WE UNLOADED SOME OF THE CONSIGNEMENTS AT A RENTED WAREHOUSE OUTSIDE OUR PLANE PREMISES.


NOW IS THERE ANY PERMISSION / APPROVAL REQUIRED FOR DOING SO. IF YES, THEN UNDER WHICH PROVISION


NOTE: THE MACHINERY HAVE BEEN CLEARED FROM ALL THE CUSTOM PROCEDURE.

Cenvat credit

A Company has 2 units, both in a same city, same locality, same nature of work. Both the units are registered under excise. All the sales and purchases made in the name of unit I. Unit II is acting as job worker.

At the time of audit, for the machineries situated at unit 2, department disallowed the CENVAT credit taken by unit-I.

please suggest if there is any provision under excise so that unit II can transfer credit of that CENVAT to unit-I.

New registration

Dear Sir,

We are Pvt.Ltd. company and registered with Excise dept. we have also invested our capital in Partnership firm. They are also doing job work and manufacture activity.

both entity are different, one is partnership and another is pvt ltd.

I would like to ask you, Can both are doing business in Premises

Dear Sir/Ma'am,
Our company buys electronic goods from different manufacturing companies & sells them under its own brand. It DOES NOT PAY THE EXCISE DUTY in respect of those manufactured goods. Thereafter, when the goods are returned back as defective goods they are sent to a SERVICE CENTER OWNED BY OUR OWN COMPANY (& not the manufacturing company) where they are repaired & sent back to the dealers for selling them back in the market. In this respect kindly explain to me that :-

Will we be liable to pay excise duty on those goods which leaves our service station after being rectified ?

Can we take CENVAT credit in respect of those electrical products which comes inside our service station ?

Excise duty

company was sold machinery on guarantee contract basis, which mentioned that if sold machinery not operated well it will be replaced by another same machinery.
during the year in one sale transaction, sold machinery was not operated well and company has to replace it as per contract.
company already paid duty on original sale transaction. Now my question is that whether company is liable to pay duty on removal of goods for replacement of machinery.

Cenvat credit

when electricity generated by using furnace oil and which was used for manufacturing excisable goods and also for residential house, can duty paid on furnace oil available for cenvat credit.
