Hi friends,
I want clarification on applicability of Rule 6(3) of Cenvat Credit rules, 2004. As per notification no. 03/2011 dated 01.03.2011, trading of goods become part of exempted services and difference between sale price minus purchase cost or 10% of cost of goods sold is deemed to be value of exempted services on account of trading of goods. As such, we started process for reversing proportional credit taken on these exempted services w.e.f.01.04.2011 till date by exercising option under rule 6(3)(ii) . Now, department is contending that whether you have reversed credit on for the period prior to 01.04.2011 i.e. frm 01.04.2008
Now, my question is follows :
1. Whether we need to reverse the credit proportionately before the period when trading been part of exempted services.if no, what contention we should keep in support of our allegation
2. if yes, how should value of exempted services determine. That means before 01.04.2011, valuation methodology for trading activities has not been prescribed. on 01.04.2011, trading activity is integrated as part of exempted service and valuation as specified above

Suppose,company is not able to make the payment obligation and against that the said party lifts the goods. Will the excise is levied or not on such transaction ?

What are the excise duty implications on job work charges. If an SSI unit does job work for another SSI unit exempt of Excise duty upto Rs.1.5 crores, does the SSI unit who performs job work needs to pay excise duty on the job work done. Eg: If Company "A" an SSI unit performs job work for Company "B" an SSI unit, does company "A" needs to pay excise duty on the job work done towards Company "B"? Please advice and provide your sugesstions. Regards

As per CENVAT credit rules, credit can be available to the extent of goods used in manufacturing of finished goods.
Following are the queries related to availment / eligible to take the excise credit,
1. Whether credit needs to be reversed on negative stock difference of raw material (i.e. Book stock 100 Kgs / Physical stock 80Kgs / Difference 20 Kgs)
2. Whether duty to be paid on negative difference in finished goods (i.e. Stock as per RG 1 100 Nos / Physical 80 Nos / Difference 20 Nos)
3. What is the treatment in case of positive variance in above mentioned 2 situations?
Request you to kindly provide the clarification with Rule / Notification reference.

As per Rule 10 of central excise rules ,
(1) Every assessee shall maintain proper records, on a daily basis, in a legible manner indicating the particulars regarding description of the goods produced or manufactured, opening balance, quantity produced or manufactured, inventory of goods, quantity removed, assessable value, the amount of duty payable and particulars regarding amount of duty actually paid.
(2) The first page and the last page of each such account book shall be duly authenticated by the producer or the manufacturer or his authorised agent.
(3) All such records shall be preserved for a period of five years immediately after the financial year to which such records pertain.
Request you kindly provide the clarity on following questions,
1.Whether printout of RG 1 needs to be taken daily basis?
2. Whether first page and last of the month or book needs to be ensured?
Kindly provide the clarifications to the same with rule/notification reference.

Dear Experts,
As per Notification 67/95, It has been clearly understood, Excisable goods manufactured and used within the factory to produce finished goods not required to pay excise duty.
As per valuation rules, Excisable goods which are consumed captively with in plant and dispatch to other units should be valued at cost of production 115%.
Considering the above mentioned points, required clarification on following,
1.Whether goods which are manufactured and captively consumed should be declared in excise returns?
2. If yes, where needs to be declared? Because as per revised E return format no provisions are available to declare the same?
3.Whether RG 1 is needs to be maintained for those goods?
4. Whether excise invoice needs to be prepared at the time consumption?
Request you kindly provide the guidelines to asked queries with rule reference to better understanding and update the knowledge.

but in this amount we have purchased transformer for site installation purpose and many other trading activities. and our core manufacturing is about 90 lakhs.
so please advise us about excise registration is now mandatory or not
what is excise registration eligibility in details.

Hi Sir,
I am a merchant exporter from hyderabad & i use to buy the goods from the manufacturer by paying the excise duty & vat its nearly 18%..
The same goods i sell to mumbai party, who is exporting the goods to dubai.. & he is submitting the ct-1 bond to me for taking goods without payment of duty.
In that case i am unable to bill the excise duty part because he is exporting the goods..
In that case how can i get back the excise duty which i already paid to the manufacturer. Please clarify is there any clause to get back the ED.
Please let me calrify what is the procedure for getting back the duty from excise department.
