Cenvat credit

Hi Friends,

Please suggest any planning for the below case-

Three Parties involved namely A- Manufacturer, B- Dealer(Wholesaler), C-Consumer. A issue excise invoice to B but B is unable to claim excise cenvat credit bcoz he is not registered under excise.If B takes excise registration then he claim cenvat credit but there is one more problem that consumer doesn't want bill.The crux is that dealer can avail credit only if he is able to pass the benefit of same to end consumer.If he claimed the cenvat without issuing bill to consumer, then cenvat claimed wil be of no use.I hope i have drafted my question well.

Exciseable goods purchase return

Dear Experts
Can we issue sales invoice for returning of exciseable Goods to original supplier from our routine invoice series?
Or we have to maintain another invoice series for purchase return?

Cenvat not shown in er1

Dear Experts,

We could not show the CENVAT in one purchase invoice in ER1 in this month. can we show it next month return? or any solution available.

Cenvat on capitalgoods

I AM MANUFACTURERE, I take cenvat credit on capital goods 50% in first year and also in first year i remove that capital goods removal as such then what about remaining cenvat credit of next year

Export to nepal in indian rs

Sir,

We are registered manufacturing company under excise rule we want to export to nepal consideration should in indian Rupee so what proceture we can follow to complete the export.

we are manufacture, most of our clearance are under FOB sales,

shall we show the Freight/Transportation charges separately in invoice, after excise and VAT/CST.

is it correct.

GTA service tax we are paying separately

Excise importer dealer

Mr A is registered as importer under Central Excise in state on Mumbai. Subsequently have also registered as importer under Central Excise in state of Gujarat. The transactions as follows:

Mr A imports a particular goods to Mumbai Godown and than after makes a branch transfer to the branch in the State of Gujarat. On receiving the goods at Gujarat, a sale transaction is undertaken with the customer.

Kindly suggest whether goods brought in the state of Gujarat through Branch transfer will hold the status of importer or there is any change in the stage of the Importer Dealer as First Stage Dealer ?

Final products are destroyed in fire & excise duty remitted thereon -whether cenvat credit availed on inputs used in manufacture is tobe reversed? Please replay

Regarding excise

Respected sir,

We are manufacture of HDPE Non-Woven Sacks Bags and HDPE Fabrics both products we are sale to customer. but HDPE bags make from HDPE Fabrics, this fabrics use in plat for HDPE Bags, it is captive consumption or not
please tell me,and what this consumption is excise duty free.

please tell me.
