Registration in Excise


We are importers of Signage Printing material (PVC Cloth rolls used for preparing Sign Boards/Advertisement Boards) i.e. Raw material for preparing Signage Boards.

At present we are paying custom duty comprising Basic Duty, Counter Veiling Duty and Additional Duty and claiming refund of Additional Duty paid by us after making the sale of the complete imported stock against a particular Invoice.

We are basically Traders i.e. import the raw material and sell it to the Dealers/Printers after charging 5% VAT. There is no Value addition in the product from our end.

Please guide us if we get Excise registration, whether we will be in a position to issue Excisable Invoices and pass on CENVAT benefit to our Dealers/Printers

I would be grateful, if Rules and related links may please be informed.

We were supplying excisable goods for constructing industrial godowns and sheds. I had little doubt regarding the supply. We are doing one work in this work it includes all the excisable rawmaterials (structures)for constructing the shed and also we were sending the non excisable goods like lighting sheets for fixing of lights and self drilling screws for fixing of sheets and turbo ventilators for cooling solutions. We were paying excise duty on raw materials (Structures),Now i had doubt regarding non excisable suply of lighting sheets, screws & turbo ventilators, whether we have to pay excise for that non excise items or not? we were fixing the above non excise items on our structures. so we have to pay excise duty on the non excisable sales also? or not? In the central excise audit, audit party objected whether you have purchased with non excise but you are using in the structure which was a excisable product so you have to pay for the total amount on non excise sales also. please give me solution.

Change applicable from

I found there is a change in excise duty rate in the budget on 26/02/2010

I found that the notification is issued in date 27/02/2010

Q.1 Change in excise duty rate is applicable from Notification Date or Budget Date?

Excise duty increased

can any one tell from when the Excise rate changes from 8 % to 10% will come to effective?

We were executing the works contracts. We were the manufacturers of steel structures for industrial and commercial godowns. In this part we were purchasing the M.s.plates, sheets, m.s.strips, I.S.M.B, M.S.Angles, Squares, Rounds with Excise from manufacturers and also without excise from traders and also purchasing non excisable products like lighting sheets, turbo ventilators and self drilling screws . I had little doubt regarding the supply. Agriculture Equipments Excise Refund.

we are Agri Equipment manufacture in Sangali,Maharastra.India.

Dear Sir,

Please Guide in Case of Excise.

My Firm is not Registered with Central Excise because my product is use only for Agriculture purpose.

But for production process i have to use Excisable material.

Can i avail cenvat againest my Exciseable material .or There are any provisions in Central Excise for Agriculture Equipments

alteration of mrp

1. if retail price declared on the package at the time of removal is subsequently altered to increase the price, such increased price will be retail price for purpose of section 4A
2. as per section 2(f)(ii) altering price will be deemed manufacture
3. as per section 4A(4)(b) if the manufacture alters the retail price goods are liable to confiscation
4. as per rule 23 of packaged commodities rules alteration of MRP is prohibited


I have found all these statements in v s datey book for indirect taxes. I want to know which one is correct for the question of, effect of altering mrp printed on the package

EXPORT BY OTHER.

Dear Experts,
Our customer purchase Batteries from us. That batteries are specially for solar lighting. One of Solar Lighting Manufacturing Co. wanted to purchase batteries from us. And they will do export with their Lighting equipments.
Now is there any Rule is there where excise duty and Vat will be exempted?
Kindly inform me.

central excise

IN indirect taxes v s datey


Deemed manufacture is classified into 2 types. In the 2nd type in has been mentioned as follows


“in respect of goods specified in third schedule to central excise act repacking, relabelling, putting or altering retail sale price etc. will be manufacture. The goods included in the third schedule of central excise act are same as those on which excise duty is payable u/s 4A on basis of MRP printed on the package”


My doubt is, third schedule to CETA covers the goods to be valued under MRP provisions. But in the above definition it is specified as third schedule to central excise act. Is it correct?
