hi all,
why we take refund of CVD paid under custom tariff act under sub section 5 of section 3
and why do not take credit of CVD paid under custom tariff act under sub section 1 of section 3

If goods are destroyed in factory/outside the factory then Excise duty will be payable or not? If goods are not in condition to sell and sold as a scrap then excise duty will be payable or not?

Cenvat credit

we are purchasing scrap from 100% EOU company, they are charging the following duties in their invoice, 1)5% on CD50% of BCD, 2)CVD 12%, 3)Edu cess on CD 3%, 4)Cenvat12% and ED and HEC for cenvat. above 4 items what are they eligible for take vat credit? pls advice

100% EOU unit selling their SCRAP items, what are the duties they should put in their excise invoice? what is the invoice rule for 100% EOU ?

Export against bond

Dear Friends, our company is going to export to middle east. I just want to know the procedure to clear the goods without paying excise. one of my colleague told me that you can clear the goods using bond clearance. is there is any provision, if yes, kindly provide me the procedure for getting the bond from excise department ? waiting for your valuable reply at the earliest.

A Hosiery Industry liable to excise duty on 30% of MRP. But as the export sales is exempt and there is no concept of MRP in export, then what will be the assessable value for ARE-1 purpose:-
1. 30% on MRP as Local Sale
2. 100% invoice vale
3. 30% invoice vale

Manufactring process or not

I want to konw that following process is manufacturing process Or not & this is attract excise duty liability if turnover crosses the thresold limit

Purchase waste & Scarp of Cables & wires & Transformer & segrecate the material & sell as copper scrap,alluminum scrap,ms scrap,pvc scrap,& chapter heading is also change for cable scrap,transformer scrap & copper scrap,alluminum scrap,pvc scrap,ms scrap,can we asay that this is the manufacturing process

Cenvat credit


We are Maruti Authorised Car We sale as well as provide service at our workshop.
We charge Service tax from customer on our job work bill. our revenue turn over is more than 100 crores. My question , are we liable also to exice duty .

we are the manufactured of A & B product.in Product A we have not taken any credit of RM & PM material and paid duty @ 2%. But in case of product B we have taken the cenvat credit on RM & PM material and paid duty @ 6% . my question is that the if we reprocess the scrap of product B and same is used in product A then what is the procedure of Excise duty paid or not? Please help us.
