We have a manufacturing unit . we import machinery from China. On Bill of entry the following duties are chargeable
Basic Custom duty
CVD 12% equivalent to excise duty
Special CVD 4%
Education Cess & Secondary higher education cess both on BCD & CVD.
we can take the cenvat credit of Cvd 12% & Special CVD 4%.
My question is that can we take the credit of education cess 2% & SH education cess 1% charged on CVD 12% ?
Please reply as early as possible with some notification or any other guideance.

we have to do payment in centralised registration no for CED but instead of it payment done in own assessee code,used till the previous year ie before centralised regn.Is there any solution or procedure to rectify the mistake done?

I am first stage dealer and registered under Central Excise. I am selling the goods to the customer registered with excise and some of our customer not registered with excise. I issued excise invoice to my customers.
My querry is that:
1. Can I issue Excise Invoice to Non-Excise customer also. If yes, then duty and manufacturer information is necessary to provide in the invoice. As there is no need to passed on Cenvat Credit to Non-excise Customer.
2. I can enter the invoice also in RG23D as NIL duty passedon.
3. In quartely return there is need to provide information of such invoices with NIL duty passedon.
We are Developer of Software and Hardware, We are planning to register for excise, Pls advise how to register with Excise..can we apply for First Stage Dealer or Second Stage Dealer as we are directly purchasing material form manufacturer and we ant to pass on Excise to our customer..Kindly advise how to deal with it..do we need to file Excise return for it also..?

Very recently we have registered with central excise as an delers. We are importers and selling locally, we would liket to pass on the benefit of ED 12.36% and additional duty 4% to our end customer. so is it possible to passon benefit??
Plesae let us know what are all the benefits we may get beeing registered as an a delear with central excise. (or) we can passon the same to end customer.

Dear Friends,
We are manufacture of Excisable goods. Excise duty charged at the time of removal of goods from factory but some time some goods are return back by the buyer, in such case excise duty already paid by us will not reverse back as dealer did not raised excisable invoice. Doing this we suffer excise losses.
I just want to know from my senior friends that are there any provision available in Excise so we can take credit (on which we already pay duty).
It will be more helpful for me if you provide Section wise details.

If a merchant exporter (not manufacturer ) acquires input from one party then, forwards it to 2 nd party (SSI )who manufactures it on job work basis and later clears it to the ME for exports . Can the ME avoid the excise duty paid on his purchase . is there any circular / notification in this regard.
