I am a CA student, currently pursuing CA-IPCC. Due to my financial constrain I am willing to do a job right now. Accordingly I have applied to a well reputed business process management Company in Kolkata for an accounts job & also got selected after several interviews, now the company is asking me to give a declaration, stating that I will not continue my CA course ever in my life. They ask me to give the declaration in a hand written letter format. I asked the HR executive what they intend to do with the declaration ? They said they will forward my declaration to the ICAI & will ask ICAI to cancel my CA registration!
I want to know- Is it legal to ask a candidate to give such declaration? Does ICAI provide the authority to any company to cancel a student's CA registration even if he/she give them such declaration?

I have confusion with regards to gratuity payout, As per law it says employee is eligiable for grataity on completion of 5 years, but it also says gratuity is payable if employee complete 4.8 years in organaisation.
Please help me unstand which one is coorect one, what is role unpaid leaves , or link for complete gratuity Law.

One of my client is having doubt in the areas of work contract tax.
The case is:
The company is manufacturing air conditioners and they are doing annual maintance service also. Company has to predict a contract value say Rs 1 lakh. That includes both material charges and labour charges. For this type of composite contract, both service tax and VAT will be applicable. In addition to this, company has to pay work contract tax also. That will be a large burden to company.
My question is how to avoid work contract tax in these type of contracts. Please give me a solution ASAP.
