Assesseee in default

17 December 2011 I m working in a Bank as credit manager , one of the file of big customr showing tax payable of 3.5 crores in ITR of AY 11-12 , 1.69 Cores in ITR of AY 10-11, As per customer he has some matter in scrutiny and hence he has not paid tax , tax of AY 10-11 Paid on Feb 2011 , Tax of AY 11-12 is still not paid and ITR of AY 09-10 also shows tax payable , hence it looks habit of customer of paying tax late , can it be consider assesee in default??

19 December 2011 Dear Soni,

Mere late payment of taxes cannot be taken as a default from the side of the assessee. It may be that the assessee pays taxes after he is served with intimation u/s 143(1).
