Appointment of managing director

19 February 2015 A person has been appointed as a director at the time of june 2013.
But from 2013 to 2015,his designation has been changed in the documents as managing director.
Now can the director file the respective E-Forms with maximum penalty and with a retrospective effect?

20 February 2015 whether such appointment is also showed in the portal of MCA in View Signatory Details. If Not,

It is better to make a fresh appointment by following New guidelines of Companies Act, 2013

20 February 2015 MCA signatory details reveals him as a director from incorporation of private company.

Due to the mistake of changing his designation as a managing director while signing business agreements , Director needs to appoint him as a Managing director in New guidelines of companies act,2013 by paying Maximum penalty and also with the retrospective effect to display him in the signatory details as a managing director from the incorporation date.

Whether he can do so?

21 February 2015 if it more than 6 months then it is advisable to file a fresh appointment as per New Companies Act,2013
