25 November 2008 hello,
i have a query regarding PF applicability.A recent amendment came up on Oct 2008 which says that, A foreigner working in India is eligible for PF reg. if so, is it applicable even if in his Indian firm has less than 20 members.
my second query is If its applicable for only that individual foreigner than should everyone in that company has to get registered even the number of people working is less than 20.
(because if, for one person its applicable whole firm has to get registered)

25 November 2008 As per amendment mentioned by you that a foreigner is eligible for PF, does not mean that your firm is required to get registered under the PF Act. Even your other workers are also eligile for PF.

Eligibility does not mean mendatory. If the word MENDATORY OR COMPULSORY were used in the amendments then you need to get registered under the PF Act.

27 November 2008 Thank you sir. was actually waiting for an answer. so does that mean minimum number doesnt matter? because if number of members are less than 20 than no need of getting registered. so..
