05 August 2014 The Company was incorporated on 01/05/2013, now as per old companies act, 1956, the first AGM should be within 15 months from the date of incorporation i.e. should be on or before 30th July 2013.

Pl. know me whether company should convey its first AGM before July or as per new act within 9 months from the date of closure of first financial year ?

05 August 2014 You first FY would be from 01.05.2013 to 31.03.2014 and for the purpose of holding AGM you will be governed by CA 1956.

As per section 166 of CA 1956, first AGM should have been held within 18 months from the date of incorporation.

As per my understanding last date for holding AGM is 31.10.2014.

05 August 2014 Further there is no point for applicability of section 96 of CA 2013. It is applicable on the companies incorporated under CA 2013. You case will be governed by section 166 of CA 1956.
