CAN HE GET REFUND??? VERY URGENT ISSUE....

23 March 2010 X is a salaried employee, who is residing in one flat since Aug 2009. when he was purchasing that flat he paid service tax amounted to Rs. 40000 to the builder's. and also he had obtain service tax challan.
CAN HE(SALARIED EMPLOYEE) GET REFUND FOR THE SAME.
PLEASE HELP OUT ME FOR THIS REGARD.
