18 August 2011 i received my tds certificate as well as of my brother for deduction of tds on rent on joint property

but the company who deduct tds on rent was wrongly entered my 2 month tds in my brother tds certificate

now the position is like that
i have 10 month tds certificate.
my brother has 14 month tds certificate.
i have to file my ITR.
can my brother claim 14 month tds refund if refund is there.

or suggest some other treatment so that i can file my correct ITR

18 August 2011 you need to ask the deductor to correct the same and amend the TDS certificate and return as well.

18 August 2011 Accodring to act if the tds deducted and certicate issued wrong,then the same has to be corrected by the deductor, deductor have no option to refuse to do that.

other way. based on certificate you can claim the TDS. but in case in future the deductor`s auditor or A.O. found the mistake then that time deductor correcting the return again you need to pay the tax with interest. because non deduction of tds will lead to disallowance and showing excess deduction in others deductee cannot allowed , sure in future deductor need to correct that, so ask now itself to do the correction
