12 July 2013 I want to file return of trust for them which ITR is required to file if the trust is sole beneficiary Individual and income of trust is only interest income and savings bank a/c interest which comes to 133359/- and tax calculation is either NIL or applicable @ 30%

12 July 2013 ITR 7 needs to be filed

12 July 2013 this form is required to file online and what are tax rate slab 10% or 30%.....

12 July 2013 no e filing of itr 7 is not allowed.

12 July 2013 i) If the trust is registered with income tax department u/s 12A and claims the benefit under section 11, then return has to be filed in ITR-7. As per proviso to rule 12(3) of the Income tax Rules,1962, ITR-7 has to be electronically filed with or without digital signature.

ii) If trust is not registered with income tax department and not enjoying section 11 benefit, ITR -5 may be used for filing income tax return which can be furnished in paper form also.

If the trust is registered under Section 12A (i.e., enjoys exemption benefits under Section 11):

Use ITR-7 form for filing.

ITR-7 filing must be done electronically (online), with or without digital signature as per rule 12(3).

Tax rates for income not applied to charitable purposes are generally 30%.

If the trust is NOT registered under Section 12A (no exemption claimed):

File using ITR-5 form (used for firms, AOPs, trusts without exemption).

ITR-5 can be filed in paper form or electronically.

Tax rate applicable is generally 30% on total income.

How to check if your trust is registered under Section 12A?

You can check with your trust’s PAN and visit the Income Tax Department’s e-filing website or call the assessing officer who handles your case.

Alternatively, you may check your trust's registration certificate or approval letter issued by the Income Tax department.

Summary:

Registered under 12A = ITR-7 (online mandatory)

Not registered = ITR-5 (paper or online)
