17 February 2010 MY CLIENT IS DEALING IN RENTING OF PORTABLE TOILETS AND AIR CONDITIONER . SHOULD THESE SERVICES BE TREATED UNDER SERVICE TAX OR DVAT.

17 February 2010 There is specific service category for "Renting of immovable property "in Service tax.so in your case i feel it is not immovable property so Service tax will not be applied.

There is specific provision in GUjarat Value Added tax for "transfer of the right to use any goods for any purpose for cash,deferred payment or other valuable consideration".so if the transaction takes place in Gujarat then you need to check out for applicability of VAT.

I T0TALLY AGREE WITH YOU THAT IT IS COVERED UNDER RIGHT TO USE IN DVAT AS WELL AS UNDER GUJRAT VAT .
I JUST WANTED TO KNOW WHETHER CAN WE TREAT THIS UNDER EVENT MANAGMENT SERVICE HEAD UNDER SERVICE TAX.
