14 December 2013 An Assesee has paid service tax for the period 2010-2012 on time but did not file returns for any period.
How can he avail the benifit under VCES or he has to pay late filing fee and file returns for all the periods.

14 December 2013 In this case you can not avail the benefit of VCES, as no "tax dues" are pending.

14 December 2013 Suppose i had to pay 10000 for QI of Fy 2012 and i paid only 9000 but didnot file the return. Now can i pay the difference 1000 and escape from paying late filing fees.

If there is tax dues pending for the period Oct-2007 to Dec-2012, then VCES scheme is applicable and shall get immunity from penalty, interest or any other proceeding under the Chapter.

14 December 2013 Thats what m asking If i tell that i have paid less amount of service tax and not filed return then can i pay the difference and waive penalty and late fees of non filing of service tax return.

From the query raised by you, it appeared to be genuine one. Now what you are asking is the way to escape from paying late filing fee. Therefore, i do not consider it to give any suggestions in this regard.
