Vacancy allowance sec 23(1)(c)

19 January 2011 I have a client who has a flat. all these years he had let out the flat and accordingly was declaring Income from House Property. During this financial yearthe same could not be let out and same thong will continue till Mar 11. Can it be claimed that ALV as nil since for whole of the year the flat remained vacant?

Simple reading of Sec 23(1)(c) rwr 4 does not give a clear picture/answer to my query.

I think I have decided case in my favour iro Amrit Petroleum decided by Bombay Tribunal

20 January 2011 Yes, you can take ALV as zero, if the flat remained vacant for whole year.
