Here’s a quick guide on forming a Religious Trust for a temple, along with 80G exemption details:
---
### 1. **Formation of Religious Trust:**
* **Trust Deed:** Yes, a **trust deed** is essential. It should clearly state the **purpose is religious**, like managing a temple and conducting religious activities.
* **Minimum Members:** Usually, **two trustees are required** to form a valid trust. More trustees can be appointed as per the deed.
* **Stamp Paper:**
* The **stamp duty depends on the state** where the trust is registered. * Generally, a **stamp paper of Rs. 100 to Rs. 1000** is used for trust deeds. * You must check the **local Stamp Act** for exact rates.
* **Registration:** Register the trust deed at the local Sub-Registrar’s office. Registration makes it a **valid legal entity**.
---
### 2. **80G Exemption:**
* **Applicability:** Once the trust is **registered under the Indian Trusts Act or relevant state law**, it can apply for 80G exemption.
* **Minimum Period:** **No fixed minimum period** is prescribed by the Income Tax Department for applying for 80G exemption. You can apply **immediately after registration** of the trust.
* **Approval Process:** The Income Tax Department will verify the deed and activities before granting 80G certificate.
