PL CONFIRM IF PARTY ARE PRINTING DEBIT NOTES INSTEAD IF INVOICE/BILL ON SALES COMMISSION OR ANY TYPE SERVICE CAN WE AVAIL SERVICE TAX CREDIT OR NOT. IF YOU HAVE ANY CASE LAW RELATING TO THE CASE PLEASE SEND RELEVANT SUPPORTING.
I AM WORKING WITH CEMENT INDUSTRY AND OUR AGENT IS SENDING INVOICE WITH PRINT DEBIT NOTE FOR HIS SALES COMMISSION OR ANY THER EXPENSES WHICH HAS BEEN INCURRED BY HIM ON OUR BEHALF. NOW THE AGENT IS PRINTING ONO HIS BILL DEBIT NOTE. THE EXCISE PEOPLE IS DISPUTING THE MATTER FOR PRINT DEBIT NOTE INSTEAD OF BILL/INVOICE.
MY QUESTION IS CAN WE ADVICE TO PRINT DEBIT NOTE TO OUR AGENT OR TO PRINT INVOICE/BILL.

Cnevat credit is a facilitating provision and normally the substacne would prevail over form. However it is possible that the same wouldbe disputed.
If the debit note were tohave all the details as required in the bill/ invoice legally the same cannot be denied.
